Regulations of the Meversepsychology Website
The owner and administrator of the Meversepsychology website is:

§1
General Provisions
1. These Regulations are regulations within the meaning of Art. 8 of the Act of 18 July 2002 on the provision of electronic services. (Journal of Laws No. 144, item 1204).
2. The Regulations specify the type and scope of services provided electronically by the Service Provider, the conditions for their provision and the rules for concluding and terminating contracts for the provision of these services, as well as the complaint procedure.
3. Every person has the right to browse the resources of the Website without any obligations, but as soon as they perform any activities on this Website (e.g. by placing an order for a Service, providing an e-mail address), they become its User and declare that they have read the Regulations. Website and the Privacy Policy, fully accepts the provisions contained therein and undertakes to strictly comply with them without the need to sign additional agreements on this subject. Otherwise, anyone who does not agree with the above should refrain from using the Website’s services, and the Administrator has the right to refuse such a person to provide services and sell services offered on the Website.

Definitions of terms used in the Regulations
E-mail address – means the e-mail address provided by the Customer
The administrator of personal data is the Service Provider, Karolina Etmańska Meverse Pracownia Psychologiczna, NIP: 8411737077
Customer/Service Recipient – a natural person who uses the services offered as part of the Meversepsychology website
Psychologist – a person authorized to practice the profession of psychologist in accordance with the Act of June 8, 2001. on the profession of psychologist and professional self-government of psychologists (Journal of Laws of 2001, No. 73, item 763, as amended);
Website – website under the domain www.meversepsychology.com, through which psychological services will be provided;
ICT system – a set of cooperating IT devices and software, ensuring processing and storage, as well as sending and receiving data via telecommunications networks using a terminal device appropriate for a given type of network within the meaning of the Act of July 21, 2000 – Telecommunications Law (Journal of Laws .U. of 2001, No. 73, item 852, as amended).
Agreement – an agreement for the provision of electronic psychological/psychotherapeutic services concluded between the Service Provider and the Service Recipient on the terms provided for in these Regulations.
Psychological service – means psychological assistance provided remotely by a psychologist in the form of Online Counseling
Service provider – Karolina Etmańska Meverse Pracownia Psychologiczna, NIP: 8411737077
Providing a service electronically – performance of a service provided without the simultaneous presence of the parties in the same place, by transmitting data at the individual request of the service recipient (customer), transmitted and received using electronic processing devices, including digital compression, and data storage, which is in entirely transmitted, received or transmitted via a telecommunications network within the meaning of the Act of July 16, 2004 – Telecommunications Law (Journal of Laws of 2017, No. 1907, as amended);
§ 3
Types and scope of Services
1. The following psychological services are available on the Website and are provided electronically:
Online video call via Skype, Zoom, Whatsapp or Teams
2. Services are ordered by the Customer on the website www.meversepsychology.com. There is a detailed price list and the duration of a single meeting.
3. The Customer/Service Recipient can select the type of support that suits his or her needs.
4. The choice of the form of providing the psychological service belongs to the Client/Service Recipient.
5. Information about the form of services provided by a specific Psychologist is available in the publicly available Psychologist’s profile.
6. The Agreement is concluded by ordering a psychological service in the form chosen by the Service User and making the appropriate payment, in accordance with the principles set out in paragraph V of the Regulations – Payment Rules.
7. Ordering a psychological service by the Client is tantamount to acceptance of the Regulations.
8. The selected Psychological Service cannot be shortened or extended.
9. If the Psychological Service is shortened for reasons not attributable to the Service Provider, the Service Recipient is not entitled to any claims against the Service Provider, in particular he is not entitled to a refund of the payment made for the Psychological Service.
10. If the Psychological Service cannot be provided for reasons solely attributable to the Service Provider, the Service Recipient will be offered another date for the service or a refund for the unused Psychological Service.
11. The Service Provider may refuse to provide psychological services in several cases if it considers that a remote consultation is not appropriate or sufficient for the reported problem. People in serious crisis or in the acute phase of mental illness should undergo inpatient treatment.
§ 4
Technical requirements necessary to use the Services
1. In order to use the services provided under these Regulations, the Service User must have access to an IT system in a minimum configuration, i.e. a PC with the MS Windows 95 operating system or newer, connected to the Internet and using a web browser, headphones, microphone. and webcam, as well as software enabling direct transmission of image and sound. The client must have a registered Skype, Zoom, Teams or Whatsapp account – necessary to conduct video consultations.
2. In order to complete an order for a psychological service, the Service User must have an electronic account (e-mail address).
3. The Service Provider is not responsible for technical problems or technical limitations occurring on the computer equipment used by the Service Recipient, which prevent the Service Recipient from using the Services. If the proper performance of the Psychological Service is prevented for technical reasons beyond the control of the Service Provider, the Service User is not entitled to any claims against the Service Provider, including in particular a claim for refund of the payment made.
§ 5
Payments
1. Psychological services are subject to payment, in accordance with the current price list available on the Website. The cost of a psychological service depends on its form. The form is decided by the Service Recipient.
2. Remuneration for psychological services is paid via online transfer.
3. The Client undertakes to pay the remuneration immediately after providing the Psychological Service. Payment should be made within 24 hours. after completion of the service, and failure to provide the full amount means that the Service Provider is not obliged to provide the service. Making a payment after the maximum waiting time has the same effect.
4. The psychological service is considered paid when it is credited to the Service Provider’s bank account.
§ 6
Withdrawal from the contract
1. Each party to the Agreement has the right to withdraw from the Agreement.
2. The declaration of withdrawal from the Agreement must be submitted in such a way that the other party can read it no later than 24 hours before the date of commencement of the provision of the Service.
3. If the Service Recipient keeps the above-mentioned procedure for withdrawing from the Agreement, the Agreement is considered not concluded and the Service Recipient is entitled to a refund of the fee paid for the Agreement.
4. If the information about withdrawal from the Agreement comes to the attention of the Service Provider less than 24 hours before the planned commencement of the provision of the psychological service, the Service Recipient is not entitled to a refund of the fee paid for this purpose or to any other claims.
§ 7
Rights and obligations of the parties
1. The Service Provider undertakes to keep secret the information obtained from the Service User regarding the provision of psychological services, unless the law provides otherwise. The obligation to maintain professional secrecy is not limited in time.
2. The Service Provider may stop providing psychological services to a given Service Recipient if the Service Recipient provides illegal or offensive content. In such a case, the payment made by the Service Recipient will not be refunded.
3. The Service Provider is not responsible for interruptions in the provision of the Psychological Service and the inability to access the Service for reasons beyond the Service Provider’s control.
4. The Service Provider has the right to temporarily suspend the operation of the Website due to the maintenance of the website, software and technical devices.
5. The service recipient has the right to submit a complaint in accordance with the provisions of §9 of the Regulations.
6. The Service Recipient undertakes not to use the information obtained under the contract in any way without obtaining the consent of the Service Provider in writing.
§ 8
Personal data
1. The Service Provider is the administrator of the Service User’s personal data in accordance with the provisions of the Regulation of the European Parliament and of the Council (EU) of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/ EC (hereinafter: “GDPR”) and national implementing provisions of the GDPR. Detailed information on the processing of personal data is available on the Website’s Privacy Policy.
2. Contact with the personal data administrator is possible at the general e-mail address: info@meversepsychology.com, via the contact form available on the website www.meversepsychology.com.
3. By using the general e-mail address: info@meversepsychology.com, from the telephone number available on the website www.meversepsychology.com or by writing via the contact form, we consent to the disclosure of our personal data to the personal data administrator, i.e.: Karolina Etmańśka Meverse Pracownia Psychologiczna, NIP: 8411737077.
§ 9
Complaints
1. The customer has the right to submit a complaint within 14 days from the end of the provision of the psychological service.
2. The complaint should be made in writing and sent to the e-mail address of the psychologist concerned by the complaint – Karolina Etmańska, info@meversepsychology.com
3. Complaints without written justification will not be considered.
§ 10
Final Provisions
1. These Regulations are valid from the moment of their publication on the website www.meversepsychology.com.
2. The Service Provider has the right to change these Regulations at any time and to any extent
without the obligation to inform the Website Users about it.
3. Any changes to the regulations come into force on the day of their publication on the Website www.meversepsychology.com.
4. In matters not regulated in the Regulations, the following provisions shall apply in particular: the Act of 8 June 2001 on the profession of psychologist and the professional self-government of psychologists (Journal of Laws 2001.73.763, as amended), the Act of 18 July 2002, on the provision of services by electronic means (Journal of Laws 2002.144.1204, as amended), Act of April 23, 1964, Civil Code (Journal of Laws 1964.16.93, as amended).
5. In the event of any dispute regarding the contract concluded between them, the Service Recipient and the Service Provider will take steps to resolve it amicably.
6. If a dispute regarding a contract concluded on the basis of these regulations is not resolved amicably, the court competent to resolve the dispute will be the court having jurisdiction over the seat of the Service Provider.
